Terms of Service — Ask Safely Assistant

What This Covers
These terms govern your use of the Ask Safely AI assistant, including the web app at app.asksafely.ai, the iOS app, and the Android app (together, the “Service”). By using Ask Safely in any form — including Guest mode — you agree to these terms.
If you don’t agree, please don’t use the Service.
Ask Safely is operated by SafeLife Inc., a Delaware C-Corp based in Minneapolis, MN (“SafeLife,” “we,” “us,” or “our”).
Eligibility
You must be at least 17 years old to use Ask Safely. By using the Service, you represent that you are at least 17 years of age.
We reserve the right to suspend or terminate any account we reasonably believe belongs to someone under 17.
Account Tiers
Ask Safely currently offers two tiers:
Guest — Free, No Account Required
You can use Ask Safely without signing up. Guest mode gives you 10 messages per day, auto-deleting chats (8-hour default), web search, and guided prompts. No email, no password, no account. Guest conversations are temporary and cannot be saved or extended.
Essential — Free, Account Required
Everything in Guest, plus unlimited messages, chat saving and extending (up to 14 days), chat history, cross-device sync, and more. Requires signup with an email address (or Google/Apple sign-in).
We may introduce additional tiers or paid features in the future. If we do, we’ll update these terms and give you notice before any new charges apply.
Your Account
If you create an account, you’re responsible for keeping your credentials secure and for all activity under your account. If you suspect unauthorized access, contact us immediately at mike@asksafely.ai.
You agree to provide accurate information at signup. We use your email address for account management and communications as described in our Assistant Privacy Policy.
How You Can Use Ask Safely
We want you to use Ask Safely for anything productive, creative, or helpful. That said, you agree not to:
- Use the Service for any illegal purpose or to facilitate illegal activity
- Attempt to access other users’ data, accounts, or chats
- Reverse-engineer, decompile, or attempt to extract the source code of the Service
- Circumvent usage limits, rate limits, or access controls (including Guest mode message limits)
- Use automated scripts, bots, or scrapers to access the Service
- Use the Service to generate content that exploits or harms minors
- Use the Service to generate spam, phishing content, malware, or other malicious material
- Resell, sublicense, or commercially redistribute AI-generated responses without our permission
- Deliberately attempt to make the AI produce harmful, misleading, or abusive content
- Interfere with the operation, security, or availability of the Service
- Use the Service to generate deepfakes, synthetic media, or other fabricated content that depicts real people without their consent
- Use the Service to impersonate real individuals, organizations, or government entities
- Use AI-generated output as the sole basis for automated decisions that materially affect individuals — such as hiring, lending, insurance, housing, or legal determinations — without meaningful human review
- Use the Service to generate content intended to harass, threaten, stalk, or intimidate any individual
We may suspend or terminate accounts that violate these terms. We’ll try to give you notice first, but reserve the right to act immediately for serious violations.
Your Content
What You Own
You own the messages you send to Ask Safely. You own the prompts, questions, and input you provide. We do not claim any intellectual property rights over your input.
AI-Generated Responses
AI responses are generated by Anthropic’s Claude models based on your input. You may use AI-generated responses for any lawful purpose — personal, commercial, educational, or creative.
However, AI-generated responses are not exclusive to you. Other users who submit similar queries may receive similar or identical responses. We make no guarantee of uniqueness. We also make no representations about whether AI-generated content is protectable by copyright or other intellectual property laws. The legal landscape for AI-generated content is evolving, and we encourage you to seek legal advice if intellectual property ownership is important for your use case.
License You Grant Us
By using Ask Safely, you grant SafeLife Inc. a limited, non-exclusive license to process your messages solely for the purpose of providing the Service — meaning generating AI responses, performing web searches on your behalf, and delivering features you’ve requested. This license includes the right to sublicense your content to the extent necessary to provide the Service through our infrastructure partners (such as Anthropic via AWS Bedrock and Brave Search), as described in the Assistant Privacy Policy. We do not use your content for any other purpose. This license terminates when your data is deleted.
Content You Should Not Submit
Ask Safely encrypts your data and deletes it by default. Still, you should avoid submitting content that you’re legally prohibited from sharing — such as classified government information, data you’re bound by contractual confidentiality not to disclose, or content that would violate someone else’s legal rights.
We don’t monitor or review the content of your conversations. Your chats are encrypted at rest, and we have no process for accessing them. But these guardrails exist to protect you.
AI Limitations and Disclaimers
Ask Safely is an AI assistant. It’s useful, but it has limits. You agree that you understand the following:
AI can be wrong. AI responses may contain errors, inaccuracies, outdated information, or fabricated details (sometimes called “hallucinations”). Always verify important information independently. Don’t rely solely on AI output for decisions that have significant consequences — financial, medical, legal, or otherwise.
AI is not a substitute for professional advice. Ask Safely is not a doctor, lawyer, financial advisor, therapist, or any other licensed professional. AI responses are informational, not professional advice. Ask Safely can be a helpful starting point for research, writing, and thinking through problems, but it is not a replacement for qualified human professionals. For decisions that affect your health, finances, legal rights, or safety, always consult with an appropriate professional.
AI has no memory between conversations (by design). Ask Safely does not retain context from previous chats. Each new conversation starts fresh. This is a privacy feature, not a bug.
Web search results may be incomplete or biased. When Ask Safely searches the web on your behalf, results depend on what’s available and indexed at that moment. We don’t control web content or search rankings.
We can’t control AI behavior perfectly. Despite our safety systems, AI models may occasionally produce unexpected, inappropriate, or offensive content. If this happens, please report it using the feedback tools in the app so we can improve.
Automatic Deletion
Chat deletion is a core feature of Ask Safely, not a side effect. Here’s how it works:
- Default: All chats auto-delete after 8 hours. This is enforced at the database level via TTL (time-to-live) indexes.
- Extended: If you extend a chat, it’s retained for up to 14 days, then permanently deleted.
- Instant: You can delete any chat immediately.
- Account deletion: Deleting your account permanently removes all data across all databases.
“Permanently deleted” means gone. Hard-deleted from the database. Not archived, not soft-deleted, not recoverable by us or by you. If you delete something and later want it back, we cannot help — the data no longer exists.
You’re responsible for saving any information from a conversation that you want to keep before it’s deleted. We recommend copying important content out of Ask Safely before the deletion timer expires.
Availability and Service Changes
We aim to keep Ask Safely available and reliable, but we don’t guarantee uninterrupted service. The Service may be temporarily unavailable due to maintenance, updates, infrastructure issues, or events beyond our control.
We may modify, update, or discontinue features at any time. We’ll give you notice of material changes.
Force majeure. We are not liable for any delay or failure to provide the Service caused by events beyond our reasonable control, including but not limited to: natural disasters, acts of war or terrorism, pandemics, government actions, failures of third-party infrastructure providers (including AWS and Anthropic), internet outages, power failures, or labor disputes.
Intellectual Property
Our IP
The Ask Safely app, web app, design, brand, and underlying technology are owned by SafeLife Inc. and protected by copyright, trademark, and other intellectual property laws.
“Ask Safely” is a trademark of SafeLife Inc. “SafeLife,” “AI with Amnesia,” and “One Memory” are trademarks or service marks of SafeLife Inc.™ You may not use these marks without our prior written permission.
Open-Source and Third-Party Components
Ask Safely may incorporate open-source software and third-party components, each subject to their respective licenses. Nothing in these terms restricts rights granted under applicable open-source licenses.
Privacy
Your privacy matters to us — it’s the reason we built this product. Please read our Assistant Privacy Policy for complete details on what we collect, how we protect it, and when we delete it. The Privacy Policy is incorporated into these terms by reference.
The short version: we encrypt everything, delete by default, never train on your data, and never sell it.
Termination
By You
You can stop using Ask Safely at any time. If you have an account, you can delete it through the app’s settings or by emailing mike@asksafely.ai. Account deletion permanently removes all your data.
By Us
We may suspend or terminate your access to Ask Safely if:
- You violate these terms
- You use the Service in a way that harms other users or our infrastructure
- We reasonably believe you are under 17 years of age
- We’re required to by law or legal process
- We discontinue the Service entirely
Disclaimer of Warranties
Ask Safely is provided “as is” and “as available.” We don’t make any warranties, express or implied, including but not limited to:
- Warranties of merchantability, fitness for a particular purpose, or non-infringement
- Warranties that the Service will be uninterrupted, error-free, or secure
- Warranties regarding the accuracy, reliability, or completeness of AI-generated responses
- Warranties that the Service will meet your specific requirements
You use Ask Safely at your own risk. The AI may produce errors, and we cannot guarantee the quality or correctness of any response.
Limitation of Liability
To the maximum extent permitted by applicable law, SafeLife Inc. and its officers, directors, employees, and agents will not be liable for any:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, data, business, or goodwill
- Damages arising from your reliance on AI-generated responses
- Damages arising from unauthorized access to your account (where you failed to secure your credentials)
- Damages arising from the automatic deletion of your chats (which is a core feature, not a defect — see “Automatic Deletion” above for details on retention timelines and your responsibility to save any information you want to keep)
Our total aggregate liability for any claims arising from or related to these terms or the Service will not exceed $100.
These limitations apply regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and even if we’ve been advised of the possibility of such damages.
Some jurisdictions don’t allow the exclusion of certain warranties or the limitation of liability for certain damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.
Indemnification
You agree to indemnify and hold harmless SafeLife Inc. and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from:
- Your use of the Service
- Your violation of these terms
- Content you submit through the Service
- Your violation of any third party’s rights
Dispute Resolution
Informal Resolution First
If you have a dispute with us, please contact us at mike@asksafely.ai first. We’ll try to resolve it informally within 30 days. Most issues can be sorted out with a conversation.
Binding Arbitration
If we can’t resolve a dispute informally, you and SafeLife Inc. agree to resolve it through binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules. Arbitration will take place in the county where you reside (or, at your election, by phone or video conference). The arbitrator’s decision will be final and enforceable in any court.
Small claims exception. Either party may bring an individual claim in small claims court instead of arbitration, as long as the claim qualifies and remains in small claims court.
Fees. If the arbitrator finds that your claim is not frivolous, SafeLife will pay all AAA filing, administration, and arbitrator fees for claims under $10,000. For claims above $10,000, fees are governed by the AAA Rules.
Opt-out. You may opt out of this arbitration provision by sending written notice to mike@asksafely.ai within 30 days of first using the Service. If you opt out, disputes will be resolved in the state or federal courts located in Delaware.
No Class Actions
You and SafeLife Inc. agree that any dispute resolution proceedings will be conducted on an individual basis only, and not as part of any class, consolidated, or representative action. If for any reason a claim proceeds in court rather than in arbitration, you and SafeLife Inc. each waive any right to a jury trial and agree that any such claim will be brought only in an individual capacity, not as a plaintiff or class member in any purported class or representative proceeding.
Governing Law
These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law provisions, except that the Federal Arbitration Act governs the interpretation and enforcement of the arbitration provisions above.
General Terms
Entire agreement. These terms, together with the Assistant Privacy Policy, constitute the entire agreement between you and SafeLife Inc. regarding the Service. They supersede any prior agreements.
Severability. If any provision of these terms is found unenforceable, the remaining provisions remain in full effect. If the class action waiver or arbitration provisions are found unenforceable as to a particular claim or request for relief, the parties agree that such claim or request for relief will be determined by a court of competent jurisdiction in Delaware rather than by arbitration.
No waiver. Our failure to enforce any right or provision doesn’t constitute a waiver of that right or provision.
Assignment. We may assign these terms in connection with a merger, acquisition, or sale of assets. You may not assign your rights under these terms without our written consent.
Notices. We may send you notices via email (to the address on your account) or through in-app notifications. Notices to us should be sent to mike@asksafely.ai.
Changes to These Terms
We may update these terms from time to time. If we make material changes, we’ll notify you via email (for registered users) or in-app notice at least 30 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the revised terms.
If you don’t agree with the changes, you can cancel your account before the new terms take effect.
