Terms and Conditions

1. Acceptance of Terms

By downloading, installing, or using the Ask Safely mobile application, web application, or any related services ("App") by SafeLife Inc. ("we," "our," or "SafeLife"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not download, install, or use the App.

2. Description of Service

Ask Safely is a privacy-first AI chat application that provides users with the ability to:

• Engage in AI-powered conversations

• Delete conversations instantly by swiping left

• Have chats auto-delete after 8 hours of inactivity (default)

• Store conversations for up to 14 days by swiping right (with bank-grade encryption)

• Search the web through AI-powered search functionality

The App is currently available on iPhone (iOS App Store), web application, and will soon be available on Android.

3. Eligibility

To use the App, you must:

• Be physically located in the United States

• Be at least 17 years of age or older

• Have a valid email address

• Comply with these Terms and all applicable laws

4. User Conduct

You agree to use the App only for lawful, moral, and ethical purposes. Prohibited uses include, but are not limited to:

• Violating any applicable laws or regulations

• Infringing upon intellectual property rights of others

• Transmitting harmful code or attempting to gain unauthorized access

• Harassing, threatening, or intimidating others

• Using the App to develop or distribute harmful, illegal, or unethical outcomes

• Attempting to reverse engineer or extract the underlying models

• Using automated systems to access or use the App

5. Intellectual Property

5.1 App Ownership

SafeLife Inc. owns and retains all rights, title, and interest in and to the App, including all software, ideas, concepts, and content contained therein, except for third-party content.

5.2 User Inputs

You retain ownership of content you submit. By using the App, you grant SafeLife a limited, non-exclusive, royalty-free license to use, reproduce, and display your content solely for providing App services to you, including data synchronization, backup, and customer support. This license terminates when you delete the content or close your account.

5.3 AI Outputs

Regarding the status of AI-generated outputs:

• SafeLife does not claim ownership of outputs generated by the App in response to your inputs

• You are responsible for how you use the outputs

• Outputs may contain material that resembles or is derived from third-party sources, and you are responsible for ensuring your use of such outputs does not infringe on third-party rights

6. User Content

While the App primarily processes user inputs to generate AI responses, you agree that any information you provide will:

• Not violate any law or regulation

• Not infringe upon the rights of any third party

• Not contain harmful, fraudulent, or deceptive content

• Not attempt to prompt the AI to generate content that violates these Terms

7. Account Termination

7.1 Termination by SafeLife

SafeLife Inc. reserves the right to suspend or terminate your access to Ask Safely at any time, for any reason, with or without notice. This includes, but is not limited to:

• Violation of these Terms

• Suspected fraudulent or illegal activity

• Extended periods of inactivity

• Business or operational reasons

• Any other reason at our sole discretion

7.2 Termination by User

You may terminate your account at any time by:

• Deleting your account through the App settings

• Deleting the App from your device

• Requesting account deletion by emailing support@asksafely.ai

8. Disclaimers and Limitations of Liability

8.1 App Status

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE." You acknowledge that:

• The App may contain bugs, errors, or other issues

• Features may change without notice

• The App may not operate as intended at all times

• Data loss may occur

​

8.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SAFELIFE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• YOUR USE OR INABILITY TO USE THE APP

• ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN

• ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE APP

• ANY BUGS, VIRUSES, OR OTHER HARMFUL CODE THAT MAY BE TRANSMITTED THROUGH THE APP

9. Modifications to Terms

SafeLife reserves the right to modify these Terms at any time as the Product evolves. If we make material changes, we will notify you through the App or by email. Your continued use of the App following such notification constitutes your acceptance of the modified Terms.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Delaware.
